BY TENDERING MATERIALS FOR SHIPMENT VIA KITESKY GLOBAL SERVICES PVT LTDTHE SHIPPER AGREES TO THE TERMS AND CONDITIONS
STATED HEREIN NO AGENT OR EMPLOYEE OF KITESKY GLOBAL SERVICES PVT LTD ORITS SERVANTS OR THE SHIPPER SHALL ALTER OR MODIFY
THESE TERMS AND CONDITIONS.
BY THE CONDITIONS SET OUT BELOW THE LIABILITY OF KITESKY GLOBAL SERVICES PVT LTD AHEREINAFTER REFERRED TO AS KITESKY GLOBAL
SERVICES PVT LTD AND ITS SERVANTS AND AGENTS IS STRICTLY LIMITED TO THE AMOUNT STATED IN THE TERMS AND CONDITIONS CUSTOMERS ARE
THEREFORE ADVISED TO PURCHASE INSURANCE COVER TO ENSURE THAT THEIR INTEREST ARE FULLY PROTECTED IN ALL EVENTS
1. THE G.C.N.
This KITESKY GLOBAL SERVICES PVT LTD Consignment note is non-negotiable and the shipper acknowledges that it
has been prepared by the shipper or by KITESKY GLOBAL SERVICES PVT LTD on behalf of the shipper. The shipper stipulates
that they are the owner of the goods transported hereunder as per the GCN or they are the authorised agents of the owner
of the goods and that they hereby accept KITESKY GLOBAL SERVICES PVT LTD terms and conditions for themselves and as
against for and on behalf of any other persons having any interest in the shipment.
2. Shipper's Obligations & Conformations Of These Terms And Conditions
The shipper WARRANTS that each articles in the shipment is properly described on the GCN. that it does not content any
of the commodities declared by KITESKY GLOBAL SERVICES PVT LTD to be unacceptable for transport as specified under clause
11 below and that the shipment is properly marked, addressed and packed to ensure safe transportation with normal care in handling.
The shipper hereby technologies acknowledgment that KITESKY GLOBAL SERVICES PVT LTD may abandon and/ of realise any item
consigned by the shipper which KITESKY GLOBAL SERVICES PVT LTD has declare to be the unacceptable or which the shipper has
undervalued or misdeclared whether internationality or otherwise without incurring any liability whatsoever to the shipper and
shipper will save and delend indemnity and hold KITESKY GLOBAL SERVICES PVT LTD harmless for all claims,
damages, fines and expenses arising therefore.
The shipper shall be solely liable for all costs and expenses (which shall without limitations include OCTROI, STATE AND LOCAL
TAXES AND ANY SIMILAR TAXES OR IMPORTS) LOCAL TAXES AND ANY SIMILAR TAXES OR IMPORTS) related to the shipment and for costs
incurred in either returning the shipment to he shipper or warehousing the shipment pending its disposal.
The shipper acknowledges that KITESKY GLOBAL SERVICES PVT LTD is not a common damage and KITESKY GLOBAL SERVICES PVT LTD
reserves the right to refuse or abandon the barrage or transportation of any goods for any persons, firm or company and the
damage or transportation of any class of goods at its description
3. RIGHT ON INSPECTION OF SHIPMENT
KITESKY GLOBAL SERVICES PVT LTD has the right. but not the obligation to inspect any shipment
including right to discretionary opening of the shipments.
4. LIEN ON GOODS SHIPMENT
KITESKY GLOBAL SERVICES PVT LTD shall have a lien on any goods for allfreight, storage/warehousing charges Fees,
OCTROI, STATE AND LOCAL TAXES AND ADVANCES or other charges of any arising out of this transaction hereunder and may
refuse to surrender possession of the goods until such charges are paid.
The shipper will undertake to provide documentations required such as Invoice, Gate Pass, State & Central Sales Tax Nos.,
Form 31/32, any other documents to enable us to clear the shipments expeditiously. KITESKY GLOBAL SERVICES PVT LTD will not
be responsible for delays & loss due to holdups for wants of documentation and/or payment na of levies.
5. LIMITATION OF LIABILITY
The liability of KITESKY GLOBAL SERVICES PVT LTD for any loss or damage to the shipment will be strictly limited to
Rs. 100/- for each shipment (which item includes all documents or parcels) consigned through
KITESKY GLOBAL SERVICES PVT LTD by the Shipper.
6. CONSEQUENTIAL DAMAGES EXCLUDED
KITESKY GLOBAL SERVICES PVT LTD shall not be liable in any event for any consequential or special damages or other indirect loss,
however arising whether or not KITESKY GLOBAL SERVICES PVT LTD has knowledge that such damages might be incurred including but not
limited to loss of income, profif, interest, utility or loss of market.
7.LIABILITY NOT ASSUMED
While KITESKY GLOBAL SERVICES PVT LTD will endeavour to exercise its best efforts to provide expeditious delivery accordance with
the regular delivery schedule WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR DELAY IN TAME PICK UP TRANSPORTATION OR DELIVERY OF
ANY SHIPMENT REGARDLESS OF CAUSE OF SUCH DELAYS. Further, KITESKY GLOBAL SERVICES PVT LTD shall not be liable for any loss,
damage misdeliver or non-delivery.
a) Due to acts of God, force majeure, or any cause reasonable beyond the control of KITESKY GLOBAL SERVICES PVT LTD like strikes,
riots, political or other disturbances, fire, accidents to the vehicles carrying the goods, explosions, theft, flight or train
delay or cancellation or any unforeseen circumstances.
b) Caused by
i) The act, default or omission of the shipper the consignee or any other party who claims an interest in the shipment
(including violation of any term of condition, hereof) or of any person to whom a shipment is tendered by KITESKY GLOBAL
SERVICES PVT LTD for the transportation to any location not regularly served by KITESKY GLOBAL SERVICES PVT LTDregardless
of whether the shipper requested or had knowledge of such third party delivery arrangement.
ii) The nature of the shipment or any defect characteristic or inherent vice thereof
iii) Electrical magnetic injury, erasure of such damage Deisto electronic or photographic images or regarding in any form.
The shipper indemnifies KITESKY GLOBAL SERVICES PVT LTD against anybris loss, damage, penalties, action, proceedings
that may be instituted by any Government official in discharge of their duties such as Custom, Taxation, Octroi, Inspection, etc.
8. CLAIMS
a) Acceptance of the consignments by consignees, at the time of delivery will constitute a complete discharge of the contract of
carnage by the company and its liability arising form it.
b) Claims it any must be brought By the shipper/consignee and delivered in writing to the offes of KITESKY GLOBAL SERVICES PVT LTD
to the nearest location at which the shipment is accepted within 30 days of the date of such acceptance No claim shall be entertained
against KITESKY GLOBAL SERVICES PVT LTD outside of that time limit.
c) No claim for loss or damages will be entertained until all transportation charges have been paid. The amount of any such claim will
not be deducted from any transportation charges owned to KITESKY GLOBAL SERVICES PVT LTD
9. MODE OF TRANSPORTATION
The Carriers reserve the right to arrange transportation of consignments by the mode of transport best suitable for
expeditious delivery of the goods by any route and procedure and by successive couriers and according to its own handling,
storage and transportation methods.
10. APPLICABILITY
These terms and conditions shall apply to incur to the benefit KITESKY GLOBAL SERVICES PVT LTD and its authorised agents
and affiliated companies and their officers directors and employees.
11. MATERIALS NOT ACCEPTABLE FOR TRANSPORTATION
a) HAZARDOUS & DANGEROUS GOODS are prohibited for carriage under KITESKY GLOBAL SERVICES PVT LTD service.
A list of such hazardous and prohibited goods is available for reference in the booking office.
b) Consignments chemicals and drugs will only be acceptable if they do not fall under the category
of dangerous and prohibited goods and the shippers provide a declaration in writing to the effect that
the contents are harmless and non-inflammable.
c) Precious Cargo in the form of Gold, Bullion, Silver Bar,
Jewellery, Germs, Precious stones and other precious metals, Currency notes, Traveller's cheques. Cashier's
Cheques, Antiques, Stamps are not acceptable.
d) Liquor Penshables, Live stock, Human remains, Film positive, Paints, Firearms, Drugs, Lewd, Obscene or
Pomographic materials are not acceptable.
